These terms of service (hereby referred to as "Terms") apply to the ByteSabre app (hereby referred to as "Application") for mobile devices that was created by Sabyasachi Pandey (hereby referred to as "Service Provider") as a Free service.

Acceptance of Terms

By downloading, installing, or using the Application, you automatically agree to be bound by these Terms. It is strongly advised that you thoroughly read and understand these Terms prior to using the Application.

If you do not agree to these Terms, you must not download, install, or use the Application.

Description of Service

ByteSabre is a personal recovery tracking application designed to help users monitor their addiction recovery journey through:

  • Daily journal entries
  • Mood tracking
  • Recovery statistics and insights
  • Planning tools for harm reduction
  • Push notification reminders
  • Profile customization

IMPORTANT: This Application is:

  • A personal tracking tool only
  • NOT a medical device
  • NOT intended to provide medical advice, diagnosis, or treatment
  • NOT a substitute for professional healthcare services
  • NOT a crisis intervention service

THIS IS THE MOST IMPORTANT SECTION. PLEASE READ CAREFULLY.

The Application is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • The Application is a personal tracking tool for addiction recovery
  • It does NOT provide medical advice, diagnosis, or treatment
  • It is NOT a substitute for professional medical care
  • Always seek the advice of qualified healthcare providers with questions about medical conditions
  • Never disregard professional medical advice or delay seeking it because of information provided by this Application
  • The Service Provider is NOT a healthcare provider and does NOT provide medical services

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The Service Provider shall NOT be liable for:

  1. Health Outcomes: Any relapse, health complications, injuries, or adverse outcomes related to addiction recovery
  2. Data Loss: Loss of journal entries, mood data, or any other user-generated content
  3. Service Interruptions: Temporary or permanent unavailability of the Application or its features
  4. Third-Party Services: Failures, data breaches, or issues with third-party services (Supabase, Sentry, OneSignal, Google, Apple)
  5. Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
  6. Recovery Journey: The Application does not guarantee any specific recovery outcomes

You use this Application entirely at your own risk.

Intellectual Property Rights

Our Rights

All trademarks, copyrights, database rights, and other intellectual property rights related to the Application and its content remain the exclusive property of the Service Provider.

You are NOT permitted to:

  • Copy, modify, or distribute the Application
  • Extract the source code of the Application
  • Translate the Application into other languages without authorization
  • Create derivative works based on the Application
  • Reverse engineer, decompile, or disassemble the Application
  • Remove or alter any copyright, trademark, or other proprietary notices

Your Content

You retain all ownership rights to the content you create in the Application, including:

  • Journal entries
  • Notes and reflections
  • Mood data
  • Plans and activities

By using the Application, you grant the Service Provider a limited license to:

  • Store your content on our servers (via Supabase)
  • Process your content to provide Application features (e.g., calculate statistics)
  • Display your content back to you across your devices

We do NOT:

  • Claim ownership of your journal entries or personal data
  • Use your content for advertising or marketing
  • Share your content with third parties without your consent

User Responsibilities

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account
  • Not sharing your account with others

Prohibited Activities

You agree NOT to:

  • Use the Application for any illegal purpose
  • Violate any laws in your jurisdiction
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems
  • Upload viruses, malware, or malicious code
  • Interfere with or disrupt the Application's functionality
  • Use the Application to harm, abuse, harass, or threaten others
  • Scrape, data-mine, or extract data from the Application using automated means

Device Security

The Service Provider strongly advises against jailbreaking (iOS) or rooting (Android) your device.

Such actions:

  • May expose your device to malware and viruses
  • Could compromise your device's security features
  • May cause the Application to malfunction or stop working entirely
  • Void the security protections we provide

You are responsible for:

  • Keeping your device's operating system updated
  • Maintaining adequate security on your device
  • Protecting your device from unauthorized access

Device Permissions

The Application may request the following device permissions:

Camera and Photo Library

  • Purpose: To allow you to take or select a profile picture
  • Usage: Only accessed when you explicitly choose to update your profile picture
  • Optional: You can deny this permission and still use all core features

Location

  • Purpose: Used by our notification service (OneSignal) to deliver relevant notifications based on your general area
  • Usage: Only approximate location is used; your precise GPS coordinates are not stored
  • Optional: You can deny this permission and still use all core features

Push Notifications

  • Purpose: To send you recovery reminders and encouragement
  • Usage: Processed through OneSignal notification service
  • Optional: You can disable notifications in your device settings at any time

By granting these permissions, you acknowledge:

  • Camera/photo access is limited to profile picture functionality only
  • Location data is used solely for notification targeting, not for tracking
  • You can revoke any permission at any time through your device settings

The Service Provider is NOT responsible for:

  • The availability, functionality, or security of third-party services
  • Any data breaches or security incidents at third-party providers
  • Changes to third-party terms, pricing, or features
  • Interruptions in third-party services

Data and Internet Connection

Internet Requirements

Some features of the Application require an active internet connection (Wi-Fi or mobile data). The Application may not function at full capacity without internet access.

The Service Provider is NOT responsible for:

  • Inability to use the Application due to lack of internet connectivity
  • Data charges incurred from your mobile network provider
  • Roaming charges if you use the Application outside your home territory
  • Wi-Fi availability or quality

Data Charges

By using the Application, you accept responsibility for:

  • Any data charges from your mobile network provider
  • Roaming charges when using the Application abroad
  • Ensuring you have permission from the bill payer if you are not the account holder

We recommend using Wi-Fi when possible to minimize data usage.

Application Updates and Changes

Right to Modify

The Service Provider reserves the right to:

  • Modify the Application at any time without notice
  • Add, remove, or change features
  • Update these Terms of Service
  • Change pricing (currently free)
  • Temporarily suspend the Application for maintenance

Updates

The Application may require periodic updates to:

  • Fix bugs and security vulnerabilities
  • Add new features
  • Maintain compatibility with operating system updates
  • Improve performance

You agree to:

  • Accept updates when offered
  • Keep the Application updated to the latest version
  • Understand that older versions may stop working

Operating System Compatibility

The Application is currently available for iOS and Android. The Service Provider:

  • Does NOT guarantee the Application will remain compatible with all OS versions
  • May discontinue support for older operating system versions
  • Recommends keeping your device's OS updated

Service Availability

No Guarantee of Uptime

The Service Provider does NOT guarantee that the Application will:

  • Be available at all times without interruption
  • Be error-free or bug-free
  • Meet your specific requirements
  • Operate in combination with other applications or services

Right to Discontinue Service

The Service Provider may:

  • Temporarily suspend the Application for maintenance
  • Permanently discontinue the Application at any time
  • Terminate your access without prior notice if you violate these Terms

Upon termination:

  • Your license to use the Application ends immediately
  • You must cease using the Application and delete it from your device
  • Your data may be deleted from our servers (see Data Retention in Privacy Policy)

Age Restrictions

The Application is intended for users who are at least 13 years of age.

Given the sensitive nature of addiction recovery content, we strongly recommend users be 18 years or older.

If you are under 13: You are NOT permitted to use this Application. If we discover that a user is under 13, we will immediately terminate their account and delete their data.

If you are 13-17: You should have parental or guardian consent before using this Application.

Disclaimers and Warranties

"AS IS" Service

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

The Service Provider disclaims all warranties, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of information
  • Uninterrupted or error-free operation
  • Security of data transmission

No Professional Advice

The Application does NOT provide:

  • Medical advice or treatment
  • Mental health counseling
  • Addiction therapy or professional intervention
  • Crisis support services
  • Legal, financial, or other professional advice

Accuracy of Information

While the Service Provider strives to ensure the Application is updated and accurate, we:

  • Rely on third-party services (Supabase) for data storage and retrieval
  • Cannot guarantee 100% accuracy of statistics or calculations
  • Are not responsible for errors in data processing

Indemnification

You agree to indemnify, defend, and hold harmless the Service Provider, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Application
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content or data stored in the Application
  • Any health outcomes or consequences related to your recovery journey

Privacy and Data Protection

Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Please review our Privacy Policy to understand:

  • What data we collect
  • How we use your data
  • Who we share your data with (Supabase, Sentry, OneSignal, Google, Apple)
  • Your rights regarding your data

By using the Application, you consent to:

  • Our data collection practices as described in the Privacy Policy
  • The transfer of your data to third-party service providers
  • The storage of your data on Supabase's servers

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Application shall be resolved in the courts of the United States.

Changes to These Terms of Service

The Service Provider may update these Terms from time to time for any reason, including:

  • Legal or regulatory changes
  • Changes to Application features
  • Updates to third-party services
  • Security improvements

You will be notified of changes by:

  • Updating the "Effective Date" at the top of these Terms
  • Posting the new Terms in the Application
  • Sending an email notification (for material changes)

You are advised to review these Terms periodically. Continued use of the Application after changes constitutes your acceptance of the new Terms.

If you do not agree to the updated Terms, you must stop using the Application and delete it from your device.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the use of the Application and supersede any prior agreements.

No Waiver

The failure of the Service Provider to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
